Officers attempted to pull over a car on Dec. 5, 2024, after receiving a 911 call and ShotSpotter alert about a possible shooting. A 911 caller also alerted police about a suspicious license plate on the vehicle.
When the car became stuck in traffic near Utica Avenue and Park Place, officers approached on foot.
According to the attorney general’s review, Ferguson opened the passenger door and pointed a gun at police.
Officers fired 19 shots, striking and killing Ferguson. A loaded firearm with an extended magazine was recovered at the scene.
The driver was shot and injured while trying to run away. She has since been indicted on reckless endangerment and other charges tied to putting her child in danger, according to prosecutors. The child was not hurt.
The Attorney General's Office said it could not prove beyond a reasonable doubt that the officers’ use of deadly force was unlawful.
A final investigation report is expected in the coming weeks.
